Zorgvuldig met uw gegevens
Om u goed te kunnen adviseren heeft BFA persoonsgegevens van u nodig. Op deze pagina leest u welke gegevens dat zijn, waarom BFA ze gebruikt, hoe lang ze worden bewaard en welke rechten u heeft.
Brinkman Financieel Advies (BFA) is verwerkingsverantwoordelijke voor de verwerking van uw persoonsgegevens. BFA gaat daar zorgvuldig mee om, niet alleen omdat de Algemene verordening gegevensbescherming (AVG) dat verplicht, maar ook omdat uw vertrouwen de basis van het advies is.

Welke gegevens BFA verwerkt
Afhankelijk van uw vraag en het product kan BFA de volgende gegevens verwerken:
- contactgegevens: naam, adres, woonplaats, telefoonnummer en e-mailadres
- geboortedatum, burgerlijke staat en gezinssamenstelling
- gegevens over dienstverband, inkomen, beroep en werkgever, of over uw onderneming
- gegevens over uw financiële situatie, vermogen en schulden
- gegevens over bestaande financiële producten, zoals hypotheken, verzekeringen, pensioen en bankrekeningen
- gegevens over de woning, zoals waarde, taxatie en energielabel
- gegevens van uw identiteitsbewijs, voor zover een geldverstrekker of verzekeraar dat verplicht stelt
- uw doelen, kennis, ervaring en risicobereidheid, omdat BFA die op grond van de Wft moet vastleggen
- bijzondere persoonsgegevens over gezondheid, alleen wanneer dat nodig is voor een overlijdensrisico- of arbeidsongeschiktheidsverzekering en alleen met uw uitdrukkelijke toestemming
- gegevens over strafrechtelijk verleden of fraude, alleen wanneer een aanbieder daar in het acceptatieproces naar vraagt
Waarvoor BFA uw gegevens gebruikt
- het opstellen van een klantprofiel en het geven van passend advies
- het aanvragen, vergelijken en tot stand brengen van financiële producten bij aanbieders
- het beheren van de relatie met u en het uitvoeren van nazorg, zoals contact bij een rentevervaldatum of een wijziging in uw situatie
- de administratie en facturatie
- het voldoen aan wettelijke verplichtingen, waaronder de Wft, de Wwft en fiscale bewaarplichten
- het beantwoorden van vragen die u via het contactformulier, per e-mail of telefonisch stelt
BFA gebruikt uw gegevens niet voor geautomatiseerde besluitvorming met rechtsgevolgen en verkoopt uw gegevens niet aan derden.
Uitvoering van een overeenkomst
De belangrijkste grondslag. Voor advies, bemiddeling en nazorg heeft BFA uw gegevens nodig om de opdracht uit te voeren.
Wettelijke verplichting
Onder meer de Wet op het financieel toezicht, de Wet ter voorkoming van witwassen en financieren van terrorisme en de fiscale bewaarplicht.
Toestemming
Voor bijzondere persoonsgegevens, zoals gezondheidsgegevens, en voor het toesturen van informatie waar u om heeft gevraagd. U kunt uw toestemming altijd intrekken.
Gerechtvaardigd belang
Voor de bedrijfsvoering, de dossiervorming en het onderhouden van de klantrelatie.
Met wie BFA uw gegevens deelt
BFA deelt uw gegevens alleen wanneer dat nodig is voor de dienstverlening of wanneer de wet daartoe verplicht. Dit kunnen zijn:
- geldverstrekkers en verzekeraars waar BFA een aanvraag voor u indient
- Stichting Waarborgfonds Eigen Woningen (NHG) bij een hypotheek met Nationale Hypotheek Garantie
- taxateurs, notarissen en uw makelaar (indien van toepassing)
- de serviceprovider via wie BFA aanvragen indient, en het HDN-netwerk waarmee aanvragen beveiligd worden uitgewisseld
- Stichting CIS, waarin financiële instellingen gegevens uitwisselen om fraude te voorkomen
- ICT- en softwareleveranciers, zoals adviessoftware, hosting en e-mail. Met hen sluit BFA verwerkersovereenkomsten
- de boekhouder of accountant, en toezichthouders of andere instanties wanneer BFA daartoe wettelijk verplicht is
BFA brengt uw gegevens niet onder in landen buiten de Europese Economische Ruimte, tenzij een leverancier dat doet met passende waarborgen zoals de standaardbepalingen van de Europese Commissie.
Hoe lang BFA uw gegevens bewaart

De stelregel is dat BFA uw gegevens niet langer bewaart dan nodig is voor het doel waarvoor ze zijn verkregen. Bij hypotheekadvies hoort langdurige nazorg, waardoor het dossier gedurende de looptijd van belang blijft.
Wat u kunt vragen
- inzage in de gegevens die BFA van u heeft
- correctie of aanvulling van onjuiste gegevens
- verwijdering van uw gegevens, voor zover BFA ze niet wettelijk moet bewaren
- beperking van de verwerking of bezwaar daartegen
- overdracht van uw gegevens aan een andere adviseur
- intrekking van een eerder gegeven toestemming
Stuur uw verzoek naar info@brinkmanfa.nl. BFA reageert binnen vier weken. Om misbruik te voorkomen kan BFA u vragen zich te identificeren. Aan een verzoek zijn geen kosten verbonden.
Hoe BFA uw gegevens beschermt
BFA neemt passende technische en organisatorische maatregelen: versleutelde verbindingen, toegangsbeveiliging op apparaten en systemen, actuele software en het beperken van de toegang tot uw dossier. BFA controleert met wie wordt gesproken voordat vertrouwelijke informatie wordt gedeeld. Vermoedt u dat uw gegevens niet goed beveiligd zijn of dat er sprake is van misbruik? Neem dan direct contact op.
Deze website
Op deze website staan geen tracking cookies en worden geen analysediensten of advertentienetwerken gebruikt. Uw taalkeuze wordt alleen in de link van de pagina meegegeven en niet opgeslagen.
Verstuurt u het contactformulier, dan worden uw naam, e-mailadres, gekozen onderwerp en bericht per e-mail naar info@brinkmanfa.nl gestuurd. De website slaat die gegevens zelf niet op in een database. BFA gebruikt ze om uw vraag te beantwoorden en bewaart de e-mail volgens de bewaartermijnen hierboven. Om misbruik van het formulier tegen te gaan, houdt de server maximaal twee uur bij hoeveel berichten er vanaf uw internetverbinding zijn verstuurd. Daarvoor wordt uw IP-adres versleuteld opgeslagen en niet aan uw bericht gekoppeld.
De website bevat links naar websites van derden, zoals AFM, Kifid, SVn en de Belastingdienst. Op die websites is hun eigen privacybeleid van toepassing.
Klachten over privacy

Which data BFA processes
Depending on your question and the product, BFA may process the following data:
- contact details: name, address, place of residence, telephone number and email address
- date of birth, marital status and household composition
- details of employment, income, profession and employer, or of your business
- details of your financial position, assets and debts
- details of existing financial products, such as mortgages, insurance, pension and bank accounts
- details of the property, such as value, valuation and energy label
- identity document details, to the extent a lender or insurer requires them
- your objectives, knowledge, experience and risk appetite, because BFA is required to record these under the Wft
- special category data concerning health, only where necessary for term life or disability insurance and only with your explicit consent
- data on criminal history or fraud, only where a provider asks for it in the acceptance process
What BFA uses your data for
- preparing a client profile and giving suitable advice
- applying for, comparing and arranging financial products with providers
- managing the relationship with you and providing aftercare, such as contact at an interest reset date or a change in your situation
- administration and invoicing
- complying with legal obligations, including the Wft, the Wwft and tax retention obligations
- answering questions you ask through the contact form, by email or by telephone
BFA does not use your data for automated decision-making with legal consequences and does not sell your data to third parties.
Performance of a contract
The main basis. For advice, arranging products and aftercare, BFA needs your data to carry out the engagement.
Legal obligation
Including the Financial Supervision Act, the Anti-Money Laundering and Anti-Terrorist Financing Act and tax retention obligations.
Consent
For special category data such as health data, and for sending information you have asked for. You may withdraw consent at any time.
Legitimate interest
For business operations, file building and maintaining the client relationship.
With whom BFA shares your data
BFA shares your data only where necessary for the services or where the law requires it. This may include:
- lenders and insurers with whom BFA submits an application for you
- Stichting Waarborgfonds Eigen Woningen (NHG) in the case of a mortgage with National Mortgage Guarantee
- valuers, notaries and your estate agent (where applicable)
- the service provider through which BFA submits applications, and the HDN network used to exchange applications securely
- Stichting CIS, in which financial institutions exchange data to prevent fraud
- IT and software suppliers, such as advice software, hosting and email. BFA concludes processing agreements with them
- the bookkeeper or accountant, and supervisory or other authorities where BFA is legally required to do so
BFA does not transfer your data to countries outside the European Economic Area, unless a supplier does so with appropriate safeguards such as the European Commission's standard contractual clauses.
How long BFA keeps your data

The rule is that BFA does not keep your data longer than necessary for the purpose for which it was obtained. Mortgage advice involves long-term aftercare, which means the file remains relevant for the term of the product.
What you can ask for
- access to the data BFA holds about you
- correction or completion of incorrect data
- erasure of your data, to the extent BFA is not legally required to keep it
- restriction of the processing or objection to it
- transfer of your data to another adviser
- withdrawal of consent given earlier
Send your request to info@brinkmanfa.nl. BFA responds within four weeks. To prevent misuse, BFA may ask you to identify yourself. There is no charge for a request.
How BFA protects your data
BFA takes appropriate technical and organisational measures: encrypted connections, access protection on devices and systems, up-to-date software and limiting access to your file. BFA verifies who it is speaking to before sharing confidential information. Do you suspect that your data is not properly secured or that misuse is taking place? Please get in touch immediately.
This website
This website places no tracking cookies and uses no analytics services or advertising networks. Your language choice is only passed in the page link and is not stored.
If you send the contact form, your name, email address, selected subject and message are emailed to info@brinkmanfa.nl. The website itself does not store that data in a database. BFA uses it to answer your question and keeps the email in line with the retention periods above. To prevent misuse of the form, the server keeps track for a maximum of two hours of how many messages have been sent from your internet connection. For this, your IP address is stored in encrypted form and is not linked to your message.
The website contains links to third-party websites, such as AFM, Kifid, SVn and the Dutch tax authorities. Their own privacy policies apply on those websites.
Privacy complaints
