Hypotheek uit 2001? Uw renteaftrek stopt in 2031
Sinds 2001 is hypotheekrente maximaal 30 jaar aftrekbaar. Hoe die termijn werkt, wat het einde ervan financieel betekent en wat u nu al kunt doen.
Heeft u in 2001 een hypotheek afgesloten? Dan mag u de rente over die lening in 2031 voor het laatst aftrekken. Uw netto maandlasten stijgen dan, terwijl er aan uw hypotheek zelf niets verandert.
Hoe werkt de termijn van 30 jaar?
Sinds de invoering van de Wet inkomstenbelasting 2001 is de rente op een lening voor de eigen woning maximaal 30 jaar aftrekbaar in box 1. Sloot u uw hypotheek af in 2001, dan verloopt die termijn 30 jaar na de startdatum van uw lening, dus ergens in 2031. Had u al een hypotheek van vóór 2001, dan stopt de aftrek voor dat deel al op 31 december 2030.
De termijn geldt per leningdeel. Bent u tussendoor verhuisd, dan liep de termijn voor het oorspronkelijke bedrag gewoon door. Heeft u de hypotheek later verhoogd, bijvoorbeeld voor een verbouwing, dan startte voor die verhoging een eigen termijn van 30 jaar. Ook gedeeltelijk aflossen stopt de termijn niet. Veel huiseigenaren hebben daardoor leningdelen met verschillende einddata.
Wat verandert er als de aftrek stopt?
Is uw lening na 30 jaar nog niet volledig afgelost, dan verhuist de resterende schuld van box 1 naar box 3. U betaalt vanaf dat moment de volledige rente zelf, zonder teruggave van de Belastingdienst. Dit speelt vooral bij aflossingsvrije hypotheken, een veel gekozen vorm rond 2001.
Een vereenvoudigd voorbeeld
Bij een aflossingsvrije hypotheek van 200.000 euro en 4 procent rente betaalt u 8.000 euro rente per jaar. Met aftrek tegen circa 37 procent krijgt u daarvan ongeveer 3.000 euro terug. Valt de aftrek weg, dan stijgen uw netto lasten met zo'n 250 euro per maand. De precieze bedragen hangen af van uw situatie.
Er zijn ook verzachtende kanten
Uw woning blijft in box 1, dus over de waarde van uw huis betaalt u geen vermogensbelasting. Wel blijft het eigenwoningforfait bestaan. De schuld die naar box 3 gaat, verlaagt daar uw belastbare vermogen. Heeft u spaargeld of beleggingen, dan kan dat een deel van het nadeel compenseren.
U moet zelf kunnen aantonen dat u nog recht heeft op aftrek
Een belangrijk en vaak onderschat punt: de bewijslast ligt bij u. De Belastingdienst beschikt vaak niet over de historische gegevens om per leningdeel te controleren hoeveel jaren van de termijn zijn verstreken. Vanaf 2031 moet u zelf aannemelijk kunnen maken dat u nog binnen de 30 jaar valt. Bewaar daarom uw hypotheekaktes, jaaropgaven en offertes, zeker als u bent verhuisd, gescheiden of van geldverstrekker bent gewisseld.
De regels kunnen nog veranderen
Eerlijk is eerlijk: hoe de situatie er in 2031 precies uitziet, staat nog niet vast. Het ministerie van Financiën heeft samen met het ministerie van Binnenlandse Zaken en De Nederlandsche Bank onderzocht hoe met de termijn van 30 jaar moet worden omgegaan, juist omdat de regeling voor burgers en Belastingdienst nauwelijks uitvoerbaar is. De onderzochte opties lopen uiteen van het beëindigen van de aftrek voor oude hypotheken per 2031, al dan niet met een overgangsregeling bij omzetting naar een aflossende lening, tot het verlengen van de aftrek tot 2043 of een geleidelijke afbouw. Er is nog geen politiek besluit genomen.
Wat betekent dit voor u? Neem geen overhaaste beslissingen op basis van één mogelijk scenario, maar wacht ook niet passief af. Wie zijn situatie nu in kaart brengt, kan straks snel en goed reageren zodra er duidelijkheid is.

Zoek de startdatums op
Per leningdeel. Zo weet u wanneer de aftrek precies eindigt.
Reken uw lasten door
Bereken wat uw netto maandlasten worden zonder aftrek en toets of dat past bij uw inkomen, ook na pensionering.
Bekijk uw mogelijkheden
Extra aflossen, omzetten of de rentevaste periode heroverwegen. Let op: oversluiten levert géén nieuwe 30 jaar aftrek op. De verstreken jaren tellen mee.
Check uw contract
Veel aflossingsvrije hypotheken uit 2001 lopen rond 2031 ook contractueel af. Uw geldverstrekker toetst dan of verlenging verantwoord is.
Tijdig inzicht voorkomt verrassingen
Voor iedereen die in 2001 een hypotheek afsloot, eindigt de hypotheekrenteaftrek in 2031. De netto maandlasten stijgen dan, terwijl de bewijslast over uw aftrekrecht bij uzelf ligt en de politieke besluitvorming nog loopt. Juist die combinatie maakt tijdig en zorgvuldig advies waardevol. Uw situatie is bepalend: de juiste keuze hangt af van uw leningdelen, uw vermogen en uw plannen.

Since 2001, Dutch mortgage interest has been deductible for a maximum of 30 years. How that term works, what the end of it means financially and what you can do now.
Did you take out a mortgage in 2001? Then 2031 is the last year you may deduct the interest on that loan. Your net monthly costs will rise, while nothing changes about the mortgage itself.
How does the 30-year term work?
Since the introduction of the Income Tax Act 2001, interest on a loan for an owner-occupied home has been deductible in box 1 for a maximum of 30 years. If you took out your mortgage in 2001, that term expires 30 years after the start date of your loan, so somewhere in 2031. If you already had a mortgage from before 2001, the deduction for that part ends on 31 December 2030.
The term applies per loan part. If you moved house in the meantime, the term for the original amount simply continued. If you increased the mortgage later, for example for a renovation, a separate 30-year term started for that increase. Partial repayment does not stop the term either. As a result, many homeowners have loan parts with different end dates.
What changes when the deduction ends?
If your loan has not been fully repaid after 30 years, the remaining debt moves from box 1 to box 3. From that moment you pay the full interest yourself, without a refund from the tax authorities. This mainly affects interest-only mortgages, a common choice around 2001.
A simplified example
With an interest-only mortgage of 200,000 euros at 4 percent interest, you pay 8,000 euros of interest per year. With relief at roughly 37 percent, you get back about 3,000 euros. If the relief disappears, your net costs rise by around 250 euros per month. The exact amounts depend on your situation.
There are mitigating aspects
Your home remains in box 1, so you pay no wealth tax on its value. The imputed rental value (eigenwoningforfait) does continue to apply. The debt that moves to box 3 reduces your taxable assets there. If you have savings or investments, that can offset part of the disadvantage.
You must be able to prove your entitlement yourself
An important and often underestimated point: the burden of proof lies with you. The tax authorities often do not hold the historical data needed to check, per loan part, how many years of the term have passed. From 2031 you must be able to demonstrate yourself that you are still within the 30 years. So keep your mortgage deeds, annual statements and quotations, particularly if you have moved, divorced or switched lenders.
The rules may still change
To be clear: exactly how the situation will look in 2031 has not yet been decided. The Ministry of Finance, together with the Ministry of the Interior and De Nederlandsche Bank, has investigated how the 30-year term should be handled, precisely because the arrangement is barely workable for citizens and the tax authorities. The options examined range from ending the deduction for old mortgages in 2031, with or without transitional arrangements when converting to a repayment loan, to extending the deduction to 2043 or phasing it out gradually. No political decision has been taken yet.
What does this mean for you? Do not make hasty decisions based on one possible scenario, but do not wait passively either. If you map out your situation now, you can respond quickly and well once there is clarity.

Find the start dates
Per loan part. That tells you exactly when the deduction ends.
Calculate your costs
Work out your net monthly costs without the deduction and test whether that fits your income, including after retirement.
Review your options
Additional repayment, converting or reconsidering the fixed-rate period. Note: refinancing does not create a new 30-year term. The years already used still count.
Check your contract
Many interest-only mortgages from 2001 also expire contractually around 2031. Your lender will then assess whether extension is responsible.
